The Company may terminate Employee’s employment hereunder at any time without cause, provided, however, that Employee shall be entitled to severance pay in the amount of two weeks of Base Salary in addition to accrued but unpaid vacation, less deductions required by law, but if, and only if, Employee executes a valid and comprehensive release of any and all claims that the Employee may have against the Company in a form provided by the Company and Employee executes such form within seven (7) days of tender. In this case, Employee’s accumulated share rights shall not be affected.
公司有权不因任何理由,从任意时刻起中止与员工的合同。此时,该员工有权获得基于其基本薪金计算出的离职金。该离职金应包括其工作两周的薪金、与其未使用的带薪休假天数相应的薪金,以及法律所规定的各种减免。但此补偿方案仅适用于该员工确实地放弃其可以针对公司所进行的赔付要求时而已。该赔付要求是指在7日有效期(犹豫期?)内,以公司认可形式,由该员工采取的针对公司的索赔要求。在此种情况下,该员工的累计股权将不受影响。
主要意思就是,公司可以随便辞退员工。如果被辞退员工,不准备根据公司内的各种制度等或其他各种根据,对公司进行索赔的话,公司会根据一定算法给予该员工一定补偿,并且对于那些有公司股权等的员工,其相关权益也不会受到影响。
